“学校没能保护我” 新州被性侵女生考虑起诉校方

新州一名被同学强奸的前高中生正考虑起诉所在学校，称尽管其家长已警告说有男生一直在威胁她，校方仍未能对她进行保护。

据《悉尼晨锋报》报导，儿童法庭周四（8月25日）判处肇事男生9个月监禁，无权获得两月假释期。该男生在2019年底犯强奸案时为16岁，翌年5月被认定犯有6项未经同意性交罪和1项未经许可故意窒息罪。

宣判后，受害女生家庭的律师Michael Bradley宣读受害者声明，称这次袭击夺走了她的自信、她的心理健康以及她“在被性侵前的幸福生活”。

受害女生说：“令我愤怒的是，这本来不应该发生。在我被强奸之前，我的父亲写信给学校，要求警方与该男生谈话并发出警告。学校同意这样做，但实际上并没有采取任何行动。”

该女生正向有关部门就对这所位于蓝山（Blue Mountains）的学校采取法律行动咨询，并呼吁该部门公布对该事件处理的内部调查结果。

她指责学校没有对她进行保护。“我只能假设学校有意掩盖在学校发生的事。发生在我身上的这件事也在澳洲许多女生身上发生过。不计其数的强奸和袭击澳洲女生的行为必须停止。” 她说。

在本月早些时候的判决听证会上，法庭获悉，两名学生之间由最初的自愿行为变成了非自愿行为，并涉及多项侵权行为。犯人并无悔意，并继续坚持无罪辩护。

在一份受害者影响声明中，受害女生说，在2019年11月底的周末聚会上，这次强奸持续了两个小时，让她感到羞耻，并受到无可弥补的伤害。

肇事男生的律师主张判处非监禁刑罚，说这个男生有一份工作，有一个稳定的女朋友，而且没有精神病态的迹象或预先存在的人格障碍。他还想学习音乐并加入空军。

受害女生的家属希望新州教育厅重新考虑对被指控男生的处理方式。目前，根据一项计划，该男生被允许回到受害女生上过的学校。

家属在一份声明中说，被指控的肇事男生应该通过视频会议软件Zoom上课，直到审判结束；如被认定有罪，他应永远不得回到受害者所在的学校。

受害女生的父亲说，希望校长访问肇事男生的数据库，当被指控或被定罪的学生转到其他学校时，校方可以采取措施保护其他学生，“被性侵学生在学校应该得到更好的帮助和照顾。”

作为对这一案件的回应，新州教育厅长Sarah Mitchell今年5月下令新州教育厅查阅国际证据，以了解在管理受害者与性侵者在同一所学校上学情况下的最佳处理方法。
